I was in an moter vehicle accident this weekend and my eye glasses were smushed so today i returned to eyemart across from the dayton mall where i always have bought them for about 10 years. I normally get my glasses every two years and it was 13 months since my last eye exam. today, dr, henn, the optomertrist at eye mart said he would not make my glasses unless i had an eye test because "it is a state law" I had the test, got my glasses and asked for the statute of that law. they said they would call me later with that info. while waiting when i got home i began making long distance calls to the state of ohio health dept and going from dept to dept (which no one heard of that law) I was connected to an investigator for the heath dept. Whilke talking with her, Billie, the manager from eyemart, called me and i put her on speaker so the investigator could hear the conversation. Billie told me that there was no law and that it was up to the eye doctor wheather he wanted to make my glasses or not. I told her that he said, in front of my fiancee' that it was a state law, not store policy. she told me that if i returned my glasses she would refund my money but i just asked for the $38.00 back for the test i was coerced into taking by misrepresentation. She refused that and when i told her that i had a state medical investigator listing on the other phone (what were the odd?) she declined to talk to me any further. The investigator gave me the web adresess to file file complants with the state against dr.henn and eye mart. the optomertrist licensencing board and the store licencing board. If i had i know it was store policy or some other silly thing, i could have walked across the street to lens crafters or stayed in middletown. so much for customer loyality.
